Please read these Terms & Conditions (“Terms”, “Terms and Conditions”) carefully before using the website located at https://winkywerldcreatives.com operated by WinkyWerld Creatives (“us”, “we”, or “our”).

1. Intellectual Property & Ownership

  • Website Content: Unless otherwise indicated, the website, its source code, design, layout, text, graphics, and logo are the property of WinkyWerld Creatives and are protected by applicable copyright and trademark laws.
  • Client Deliverables: Ownership of client-specific project deliverables (such as websites, graphic assets, and custom code) transfers to the client upon full payment of all agreed-upon fees. We retain the right to showcase completed works in our portfolio, case studies, and marketing materials unless restricted by a separate non-disclosure agreement (NDA).

2. Services, Quotes, and Scope of Work

  • Estimates & Proposals: Proposals, quotes, and project estimates provided by WinkyWerld Creatives are valid for 30 days from issuance unless stated otherwise in writing.
  • Scope Revisions: Any work requested beyond the initial agreed-upon project scope will be treated as a change request and billed at our standard rate or outlined in a separate project addendum.

3. Payment Terms

  • Deposits & Retainers: Unless otherwise specified in a project proposal, custom service work requires an advance deposit before work commences.
  • Invoicing: Final payments are due upon project completion or according to the milestone schedule detailed in your project agreement. Late payments may result in the suspension of work or hosting services until paid in full.

4. Client Responsibilities & Content Supply

  • Materials: Clients are responsible for providing all necessary content, images, brand assets, access credentials, and text required for project completion in a timely manner.
  • Licensing & Compliance: The client warrants that all text, assets, graphics, and logos provided to WinkyWerld Creatives for inclusion on their website or marketing materials are legally owned by the client or properly licensed.

5. Hosting & Third-Party Services

  • WinkyWerld Creatives is not liable for service disruptions, outages, data loss, or security breaches resulting from third-party hosting providers, domain registrars, payment gateways, or API providers, though we will assist in resolving server/infrastructure issues where applicable.

6. Limitation of Liability

In no event shall WinkyWerld Creatives, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from:

  • Your access to or use of (or inability to access or use) our site or services.
  • Any unauthorized access to or use of our servers and/or any personal or technical information stored therein.
  • Any bugs, viruses, Trojan horses, or similar technical issues transmitted to or through our service by any third party.

7. Termination
